About This Privacy Policy

MyTow.ca respects your privacy. This Privacy Policy explains how we collect, use, disclose, retain, safeguard and otherwise handle personal information when you use MyTow.ca, the service-request experience at app.mytow.ca, our customer support channels and related digital services.

Some Canadian privacy obligations may apply to our activities, including the Personal Information Protection and Electronic Documents Act (PIPEDA) where it applies, together with its fair information principles. Where a provincial privacy law applies instead of PIPEDA, we aim to handle personal information in a manner consistent with a substantially similar standard.

We have intentionally written this Policy in plain language. If anything is unclear, you can contact us using the details in the Contact Us section.

Accountability

MyTow is responsible for the personal information under its control. We maintain practices and procedures intended to give effect to the privacy principles that apply to our activities.

Privacy questions, concerns and requests can be sent to info@mytow.ca.

Where our service providers handle personal information on our behalf, we expect them to protect that information consistently with their contractual obligations and applicable privacy law. As required by applicable law, we remain responsible for personal information under our control.

Personal Information We May Collect

The personal information we collect depends on how you interact with MyTow and which services you request. The main categories are described below.

Contact Information

We may collect contact details such as:

  • your name;
  • your email address;
  • your telephone number; and
  • your preferred method of contact.

Service Request Information

When you request help, we may collect information about the request, such as:

  • the service you request;
  • your pickup location;
  • your destination, where applicable;
  • service instructions or notes you provide;
  • the time and date of the request; and
  • status information associated with the request.

Location Information

Some services cannot be delivered without location information. Depending on how you use the platform, we may receive precise or approximate location through:

  • device location permissions you grant;
  • an address you enter; or
  • a location you select on a map.

We aim to access device location only where you grant the applicable permission or where you otherwise supply the information.

Vehicle Information

To help a provider prepare for and complete a service, we may collect vehicle details you provide, such as:

  • make, model and year, where supplied;
  • colour;
  • licence plate, where required for the service;
  • vehicle condition; and
  • other details relevant to the requested service.

We do not assume that a Vehicle Identification Number (VIN) is always collected. Whether a VIN is requested depends on the specific service and how the platform is configured.

Transaction and Payment Information

Where online payment functionality is provided, payments may be processed by a third-party payment processor. In that case, MyTow may receive limited transaction information, such as payment status, a transaction reference, the amount, and billing-related information needed to support the transaction.

We do not state that we store complete payment-card numbers. Card details are generally handled by the payment processor rather than retained by MyTow.

Technical and Device Information

To the extent that the systems we operate collect it, we may receive technical and device information such as:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • pages viewed;
  • timestamps;
  • referring URL; and
  • your cookie and consent choices.

We aim to collect and describe this information only to the extent the systems we actually operate gather it.

Communications and Support

We may collect and keep records of communications such as:

  • support emails;
  • service-related messages;
  • complaints;
  • feedback; and
  • other communications necessary to handle your request.

How We Collect Information

We may collect personal information in the following ways:

  • directly from you when you submit a request, contact support or provide details;
  • automatically through website and application technologies you have authorized;
  • from towing, roadside or vehicle-transport providers involved in your request;
  • from payment or technology service providers where necessary to support a transaction; and
  • from lawful sources where permitted by applicable law.

Why We Use Personal Information

We use personal information for specific purposes, including to:

  • create and process a service request;
  • connect or coordinate your request with an appropriate provider;
  • determine and communicate pickup and destination information;
  • communicate the status of your request;
  • provide customer support;
  • process or confirm transactions where applicable;
  • maintain the safety and security of our services;
  • detect misuse, fraud or abuse;
  • maintain business records;
  • improve site and application functionality;
  • perform analytics where your consent permits; and
  • meet legal and regulatory requirements.

We do not use personal information for vague or open-ended purposes such as any business purpose.

Where required, we rely on your knowledge and consent for the collection, use and disclosure of personal information. We aim to obtain meaningful consent, which means you understand what information is being collected and why.

Some information is necessary to perform the service you asked for. Optional uses, such as optional analytics or marketing, depend on your consent and can be withdrawn.

You may withdraw consent to optional uses at any time, subject to legal and contractual restrictions and reasonable notice. If you withdraw consent for information that is required to deliver a service, we may not be able to complete that service.

How We Handle Location Information

Location information can be sensitive, so we handle it carefully. Location may be needed to dispatch the correct provider, estimate travel, or guide a provider to your vehicle.

You can supply location by granting device location permission, by entering an address, or by selecting a point on a map. You can change or revoke device location permissions in your device or browser settings at any time.

We do not use location information for unrelated purposes without an appropriate legal basis or your consent.

Disclosure of Personal Information

We may disclose personal information to categories of recipients where reasonably necessary, including:

  • towing, roadside and vehicle-transport providers needed to fulfill your request;
  • payment processors;
  • hosting and infrastructure providers;
  • security and fraud-prevention providers;
  • analytics providers, where analytics is enabled or consented to;
  • professional advisers;
  • government, regulatory or law-enforcement bodies where required or permitted by law; and
  • parties to a business transaction, where legally permitted and appropriate safeguards apply.

Because providers need certain information to deliver the service you requested, we do not describe information as never shared.

Service Providers

Third parties may process personal information on our behalf or as part of delivering a service. We expect such parties to handle information consistently with obligations appropriate to their role and with applicable privacy law.

Cross-Border Processing

Some of our service providers may process or store information outside your province or outside Canada, depending on the infrastructure those providers use. When information is processed in another jurisdiction, the laws of that jurisdiction may apply to it, and it may be accessible to authorities there under those laws.

Where we rely on service providers in other jurisdictions, we take reasonable steps to protect information through contractual and organizational measures appropriate to the circumstances.

Cookies and Similar Technologies

We use cookies and similar technologies for a small number of purposes. We group them into necessary, functional, analytics and marketing categories, and we only rely on categories that are actually implemented.

Necessary cookies support core functionality, security and remembering your cookie preferences. Optional categories remain off until you consent, and you can change your choices at any time.

For more detail, see our Cookies notice at /cookies, and use Cookie Preferences to manage your choices.

Analytics

We use analytics only where it is actually implemented and permitted by your consent settings. Analytics helps us understand how the site and application are used so we can improve them.

Where optional analytics is not consented to, we do not use it for that purpose.

Communications

We separate service and transactional communications from marketing communications.

Service and transactional messages, such as updates about your request, may be necessary to fulfill the service you requested.

If we send marketing messages, we do so in accordance with applicable consent and unsubscribe requirements, including Canada's Anti-Spam Legislation (CASL) where it applies. You can unsubscribe from marketing communications.

Retention

We retain personal information only for as long as reasonably necessary for the purposes identified in this Policy. Retention may vary by category of information and by context.

Reasons we may retain information include meeting legal and regulatory requirements, resolving disputes, preventing fraud and maintaining security, and keeping reasonable business records.

We do not state fixed retention periods unless they have been verified for the relevant category.

Security Safeguards

We use safeguards proportionate to the sensitivity of the information, including:

  • administrative safeguards such as policies and defined staff responsibilities;
  • technical safeguards such as access controls and secure transmission where appropriate; and
  • organizational controls and periodic review of our practices.

No electronic system can guarantee absolute security. We cannot promise that information will never be accessed, disclosed, altered or destroyed by an unauthorized party, and we do not describe our safeguards as guaranteed or unbreakable.

Privacy Incidents and Breaches

We maintain procedures for responding to privacy and security incidents. Where PIPEDA applies, a breach of security safeguards that creates a real risk of significant harm will be handled in accordance with applicable reporting and notification requirements, including any obligation to keep records of breaches.

This public Policy is not intended as a detailed security playbook.

Access and Correction

You may request access to personal information we hold about you, and you may ask us to correct information that is inaccurate or incomplete.

Requests can be sent to info@mytow.ca. We may need to verify your identity before acting on a request, and legal exceptions may limit what we can provide or change.

You can withdraw consent to optional uses at any time. The easiest way to change cookie-related choices is through Cookie Preferences.

For other requests, you can contact us at info@mytow.ca. If you withdraw consent for information that is required to deliver a service, we may not be able to complete that service.

Children's Privacy

MyTow's towing, roadside and transport request services are intended for persons who are legally capable of requesting and authorizing the applicable service.

We do not knowingly design the platform to collect children's personal information unnecessarily. If you believe a child has provided personal information to us, please contact us so we can address it.

Third-Party Websites

Our website and application may link to third-party sites, including TrueNorthRoadside.ca. Those third parties maintain their own privacy practices and policies, and we encourage you to review them.

This Privacy Policy applies to information handled by MyTow, and not to third-party websites or services we do not control.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we make material changes, we will communicate them appropriately where required.

The Last updated information at the top of this page identifies the current version of this Policy.
