About MyTow
MyTow.ca is a public information website for discovering towing, roadside assistance and vehicle transport services in Toronto and the Greater Toronto Area. The transactional request experience is provided through app.mytow.ca.
MyTow operates as a digital platform and customer interface. MyTow is not described here as the physical towing operator. Where a service is performed, it is generally performed by a separate towing, roadside or vehicle-transport provider.
Acceptance of Terms
By accessing or using MyTow.ca, app.mytow.ca or related digital functionality, and by submitting a request through the platform, you agree to these Terms where they are presented for acceptance.
Where a clear acceptance step is presented, you agree to those Terms through that explicit action. We do not rely on pre-checked acceptance where your express agreement is required.
Nothing in these Terms is intended to waive or limit any statutory right or protection that cannot lawfully be waived under applicable law. If any provision conflicts with a mandatory legal right, that right prevails to the extent of the conflict.
Eligibility and Authority
By using the platform, you represent and confirm that you:
- are legally capable of entering into the transaction you are requesting;
- are authorized to request service for the vehicle involved, whether as owner or with the owner's authority;
- are not requesting service for a vehicle you have no lawful right to move; and
- will provide accurate and complete information to the best of your knowledge.
You must not request towing, transport or roadside service for a vehicle that you are not authorized to have moved.
Services Available Through MyTow
Services that may be requested through the platform include:
- Towing;
- Battery Boost;
- Flat Tire Assistance;
- Vehicle Lockout;
- Fuel Delivery; and
- Vehicle Transport.
Availability may depend on your location, service-provider availability, the circumstances of your vehicle and the service requested, and applicable restrictions. Submitting a request does not guarantee that a provider will be dispatched or that a service will be completed.
MyTow's Role and Service Providers
MyTow provides the digital platform through which a request can be created and coordinated. The physical towing, roadside or vehicle-transport service may be performed by a separate service provider engaged to fulfill your request.
We do not describe MyTow as the physical service provider unless that has been separately verified for a specific service. We also do not use these Terms to exclude responsibilities that cannot lawfully be excluded.
Emergency Situations
MyTow is not a 911 service and does not provide emergency response. If there is an injury, a fire, an immediate danger, a collision requiring emergency response, or unsafe roadway conditions requiring police or emergency attention, contact 911 or the appropriate emergency authorities first.
Use MyTow only for non-emergency towing, roadside assistance or vehicle transport needs.
Service Request Information
To help a provider respond correctly, you must provide reasonably accurate information, including:
- your location, and the location of the vehicle;
- the service you need;
- your vehicle information;
- your destination, where applicable; and
- usable contact information so we and the provider can reach you.
Inaccurate or incomplete information can delay or prevent service, and can affect pricing and the outcome of a request.
Estimates, Rates and Ontario Towing Requirements
Towing and related services in Ontario are subject to requirements that cannot be waived through a website's terms. Depending on the circumstances, a towing, roadside or storage provider may be required to meet obligations relating to provincial certification, obtaining and documenting consent before towing, providing a copy of documented consent, providing estimates, following applicable maximum-rate schedules, issuing itemized invoices, providing required customer information, permissible charges, professional conduct, vehicle access, and destination or storage information.
Accepting these Terms, or submitting a request through MyTow, does not replace any separate consent, estimate, rate disclosure, authorization, invoice or other documentation that a towing or storage provider is required to provide under applicable law.
Nothing in these Terms is intended to reduce, replace or override the statutory protections available to consumers under Ontario law.
Payment and Fees
Where payment functionality is provided, providing a payment method and authorizing a payment are distinct steps. Depending on how the platform is configured, a request may involve a payment authorization, a temporary authorization hold, final invoicing, and payment capture.
We do not state that payment can be demanded or captured in circumstances where Ontario law prohibits doing so before the invoicing or documentation required by law has been provided.
Fees for the actual service are determined based on the service requested, the provider, applicable rates and the circumstances of the job, and may be subject to any estimate, rate schedule or invoice the provider is required to give you.
Cancellations
You may cancel a request before a provider is dispatched where the platform allows, and any cancellation rights that apply under a service arrangement will be governed by the terms of that arrangement and by applicable law.
We do not promise cancellation or refund rights that are not actually available, and we do not describe rights that do not exist.
Request Status and Tracking
The platform may provide status information and tracking to help you follow the progress of a request. Status and tracking information is provided for convenience and may be affected by factors such as network conditions, provider availability and circumstances on the road.
Status information should not be treated as a guaranteed arrival time or a service guarantee.
Acceptable Use
You agree not to:
- submit requests for vehicles you are not authorized to have moved;
- use the platform for unlawful, harmful or fraudulent purposes;
- attempt to interfere with, disrupt or gain unauthorized access to the platform; or
- misuse the platform in a way that harms other users, providers or MyTow.
Intellectual Property
The content, branding, design and software associated with MyTow.ca and app.mytow.ca are owned by or licensed to MyTow and are protected by applicable intellectual property laws.
You may use the platform for its intended purpose, but you may not copy, reproduce or commercially exploit our content without permission, except as permitted by law.
Disclaimers and Limitation of Liability
The platform is provided on an as-is and as-available basis. We do not guarantee that the platform will always be available, uninterrupted or error-free, or that a provider will be available for every request.
To the extent permitted by applicable law, and subject to any rights that cannot lawfully be excluded, MyTow is not liable for indirect or consequential losses arising from your use of the platform.
Nothing in these Terms excludes or limits any liability or right that cannot be excluded or limited under applicable law, including consumer protections that apply to you.
Indemnity
To the extent permitted by applicable law, you agree to indemnify and hold harmless MyTow against claims arising from your misuse of the platform, your breach of these Terms, or your submission of a request for a vehicle you were not authorized to have moved.
Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules.
Nothing in this section limits any consumer right to bring a matter before a competent forum as permitted by applicable law.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will communicate them appropriately where required. The Last updated information at the top of this page identifies the current version.
Your continued use of the platform after an update means you accept the updated Terms where they are presented for acceptance.
